1. Who these terms are between

These terms form an agreement between you and WellDepth ("we", "us"). By using this site or buying a report, you agree to them. If you do not agree, do not use the site.

2. What WellDepth is — and what it is not

WellDepth is a screening tool. It summarizes public records about properties near a point you choose and presents them with their sources and limitations.

It is expressly not, and is not a substitute for:

  • a well inspection, water test, or hydrogeological assessment
  • a septic site evaluation or any health district determination
  • a land survey or boundary determination
  • a title search, title opinion, or water-rights determination
  • an appraisal, home inspection, or environmental assessment
  • legal, engineering, financial, or real estate advice of any kind

We are not licensed as drillers, surveyors, engineers, appraisers, title agents, attorneys or real estate professionals, and nothing we publish is professional advice. No relationship of trust or reliance is created by your use of this site.

3. What we do not represent

We do not represent, warrant or promise that any parcel will support a well or a septic system, holds water rights, is buildable, can be permitted, or is free of flood or contamination risk. Groundwater and soils vary over very short distances. Public records are incomplete, sometimes inaccurate, and often approximately located.

Every figure we show describes other properties near a point you selected. None of it describes your parcel. Any decision with money attached should rest on a licensed professional's opinion about your specific parcel.

This site and its reports are not professional advice — legal, engineering, hydrological, geological, surveying, real-estate or financial — and using them creates no professional relationship of any kind between us. We arenot affiliated with the Idaho Department of Water Resources, FEMA, the USDA, the U.S. Census Bureau, any county assessor, or any public health district. We republish their public records with attribution; they do not endorse, review or supply this service.

4. The data and its sources

Information comes from public sources including the Idaho Department of Water Resources, the USDA Natural Resources Conservation Service, and FEMA. Each source is cited in the report with the date we retrieved it.

IDWR makes its records available as a public service and states that anyone relying on them for purposes requiring accuracy should first verify against the primary records. We pass that on because it is true and because IDWR asks us to. WellDepth is not affiliated with, endorsed by, or sponsored by IDWR, USDA, FEMA, or any government agency.

Source data may change, be corrected, or be withdrawn at any time. A report reflects what the sources said on the date it was generated and is not updated afterwards.

5. Provided "as is"

The site and the reports are provided "as is" and "as available", without warranty of any kind, express or implied. To the fullest extent permitted by law we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, title, and non-infringement.

We do not warrant that the site will be uninterrupted or error-free, that defects will be corrected, or that any data source will remain available.

6. Assumption of risk

Buying land is a decision you make. You accept that you are solely responsible for your own due diligence and for verifying anything you intend to rely on with the qualified professionals named in every report — a licensed well driller, your public health district, a title company, a licensed surveyor, and county planning and zoning.

7. Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to the site or a report is limited to the amount you actually paid us for that report, or $299, whichever is less. If you paid us nothing, our liability is limited to $100.

We are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost opportunity, diminution in property value, cost of drilling, cost of remediation, or any loss arising from a purchase, sale, or decision not to purchase — whether or not we were advised such damages were possible.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Where a limitation is unenforceable, our liability is limited to the smallest amount permitted by law.

8. Indemnity

You agree to indemnify and hold us harmless from any claim, loss or expense (including reasonable legal fees) arising from your misuse of the site, your breach of these terms, or your reliance on a report contrary to the limitations stated in it.

9. Payment and refunds

Reports are $79 each and are generated before you pay, so you can see what was found for your parcel before buying. Payment is processed by Stripe; we never see or store your card details.

You see what we found for your parcel before you pay, so there should be no surprises. If the report is wrong, incomplete, or a source we said we checked turns out not to have been, email us within 30 days and we will refund you in full, no argument. We would rather refund you than have you rely on something inaccurate.

10. Acceptable use

Use WellDepth to evaluate parcels. Do not scrape the site, make automated bulk requests, resell or redistribute the data as a dataset, or use it to build a competing database. Do not use it in any way that violates the terms of the underlying public sources.

11. Changes

We may change these terms. Material changes will be reflected in the "last updated" date above. Continued use after a change means you accept the revised terms. A report you already bought remains governed by the terms in force when you bought it.

12. Governing law and venue

These terms are governed by the laws of the State of Idaho, without regard to its conflict of laws rules. Any dispute will be brought exclusively in the state or federal courts located in Idaho, and you consent to their jurisdiction.

13. Severability

If any provision is found unenforceable, the rest remains in force, and the unenforceable provision is applied to the maximum extent permitted.
